Terms and conditions and rental agreement

§ 1
GENERAL PROVISIONS

These TERMS AND CONDITIONS set out the rental conditions under which you can make an individual booking and rent the apartments listed in the offer of Comfort Apartments. Making a booking is tantamount to accepting the provisions of the Comfort Apartments apartment rental TERMS AND CONDITIONS. This is a contract for the provision of short-term accommodation services between the Guest and Comfort Apartments. A Guest may be an adult. The contract concluded with Comfort Apartments covers only the rental of the apartment (without meals or transport). Comfort Apartments reserves the right to refuse to accept a booking.

§ 2
BOOKING AND PAYMENT FOR APARTMENT RENTAL

Ways to make a booking:
– online booking on the website www.comfortapartments.eu
– by phone at the number: +48 517 727 460
– via email address booking@comfortapartments.eu
– online portals www.booking.com, www.airbnb.pl etc. After making a booking, a "Preliminary booking confirmation" for the apartment you have chosen will be sent to your email address, together with the cost of the entire stay and the exact address of the apartment (please note that our apartments are located at various addresses in Gdańsk, Sopot and Gdynia).
When booking online or through booking portals, you are required to provide your credit card number with its expiry date, and the first and last name of the person making the booking.
In the case of a booking made by phone or electronically, you will receive information with the account number to which the amount towards the guaranteed booking should be paid.
After the credit card is charged or the amount is credited to the account, the booking changes its status to a "Guaranteed Booking", whereupon you will receive a "Booking Confirmation" at the email address provided.
Failure to charge the credit card or to pay the amount into the bank account towards the booking within the specified time means withdrawal from the contract and automatic cancellation of the preliminary booking.
The offer and the prices listed on www.comfortapartments.eu are for information purposes only and do not constitute a commercial offer within the meaning of Art. 66 § 1 of the Civil Code. The price must be confirmed by a Comfort Apartments employee by phone or when booking online. 

All prices offered by Comfort Apartments include the currently applicable VAT of 8%.
The price of the stay includes: bed linen, towels, wireless Internet, utility charges (water, gas, electricity, heating) and parking, where available.
The price of the stay does not include the final cleaning fee for the apartment or the local (climate) tax.
The local (climate) tax of PLN 4.30 per person per night is collected in cash.
At the Guest's request, Comfort Apartments can issue an invoice. 

Changing the booking date is possible only with the consent of Comfort Apartments and should be reported by phone or email.

§ 3
BOOKING CANCELLATION

Free cancellation of a booking is possible up to 14 days before arrival. 

In the case of cancellation or withdrawal from a booking less than 14 days before arrival, the amount paid into the account or charged to the credit card is forfeited. 

If the stay is shortened, the Guest is not entitled to a refund for unused nights.

§ 4
ARRIVAL AND CHECK-IN

The Guest is obliged to inform the staff, at the latest the day before arrival, of the planned time for collecting the apartment. If it is not possible to arrive at the previously agreed time, the Guest is obliged to contact the Comfort Apartments staff immediately. 

Check-in to apartments located in the centre of Gdańsk takes place at the Comfort Apartments office during the following hours:
from 15:00 to 19:00 – free of charge
from 19:00 to 23:00 – PLN 100 (payment must be made in cash)
after 23:00 – PLN 150 (payment must be made in cash)

Collection of keys to apartments located in Sopot, Gdynia and other districts of Gdańsk takes place at the apartment's address. To collect the keys, the Guest is asked to contact a Comfort Apartments employee at the latest 1 hour before arriving on site (the contact person's number is indicated in the "Booking Confirmation"). 

The accommodation day begins at 15:00 (if possible, after prior arrangement with the person responsible for handing over the keys, they can be collected earlier).
Check-in after 19:00 requires prior confirmation from the Comfort Apartments office. Comfort Apartments reserves the right to refuse to check in Guests after 19:00.
Comfort Apartments reserves the right to collect a refundable deposit of up to PLN 1,000.00 up to 7 business days before check-in. The deposit is collected in the form of a credit card pre-authorisation. The deposit is intended to secure Comfort Apartments' claims in the event of any damage or breach of individual points of the terms and conditions. If Comfort Apartments raises no objections, the deposit is released to the client within 7 business days of the departure date.

§ 5
CHECK-OUT AND DEPARTURE

The accommodation day ends at 11:00. Please arrange the time and details of check-out the day before departure at the phone number provided in the welcome letter or on our website. The Guest leaves the property in a condition no worse than the one in which they received it. If damage has occurred, the Guest bears financial liability for any damage to persons or property caused by their fault or that of third parties, related to the booked stay. 

Check-out takes place between 8:00 and 11:00. Leaving the apartment after 11:00 without prior arrangement with the Comfort Apartments staff will be treated as an extension of the stay by another day and charged according to the applicable price list. An extension of the stay must be reported to the Comfort Apartments staff at the latest by 15:00 on the day preceding the day on which the booked term ends. The stay will be extended if Comfort Apartments has apartments available.

§ 6
CLIENT'S OBLIGATIONS

The Client is obliged to keep the premises in proper condition, observe the principles of good neighbourliness, and use the apartment in accordance with its intended purpose, solely for the purpose related to a leisure/tourist stay or a business trip. It is forbidden to organise parties, photo sessions, etc., or to consume excessive amounts of alcohol. Quiet hours apply in the apartment from 22:00 to 06:00. Due to the apartment's location in a residential building, failure to observe this point may result in immediate termination of the rental agreement and, in more serious cases, calling the police, and is subject to a fine of up to PLN 500.00 under Art. 51 § 1 of the Code of Petty Offences. Please note that both the apartment's Guests and the residents of the entire building are authorised to report any incidents directly to the apartment Manager.
The number of people staying in the apartment may not exceed that declared in the booking confirmation. In the event of a breach of this point, Comfort Apartments has the right to terminate the Agreement with immediate effect, without the obligation to refund the amount due for the remaining booking period. 

The Guest is obliged to immediately report to the apartment's caretaker any missing apartment equipment and any damage found or caused in the apartment. 

Smoking tobacco and burning candles is completely prohibited in the apartment and throughout the residential building. For breaching the ban, in particular for smoking tobacco in the apartment, the Guest may be charged a fine of PLN 500.00. 

During check-in, the Guest is provided with the apartment together with fully functional equipment. The Guest is obliged to immediately report to a Comfort Apartments employee any damage or defects they find in the apartment. Failure to report it may result in the Guest being charged with the cost of repairs. 

The apartment Guest bears full financial liability for any kind of damage, destruction or shortage of equipment items and technical devices of the apartment caused by their fault or by the fault of visiting persons. In the event of any damage, the Guest should notify the person managing the apartment immediately after discovering it.
Neither the owner nor the person managing the apartment is liable for items left in the apartment, or for the loss or damage of money, documents or other items that are important or valuable to you. Please always lock the entrance door, both while in the apartment and during your absence, and close the windows before leaving the flat. Please take particular care of the apartment keys. If they are lost, the Guest will be charged an additional fee of up to PLN 500.00. The apartment Guest may not give the keys to third parties, and third parties staying in the apartment are obliged to leave by 22:00 at the latest. 

If the apartment manager is notified by other guests or building residents of a flagrant breach of any of the points of these terms and conditions, the Guest should be aware that the rental agreement may be terminated with immediate effect, with full payment retained for the unused days of the stay.

§ 7
ADDITIONAL INFORMATION

Comfort Apartments is not liable for inconveniences arising during the stay related to: construction or finishing works that may be carried out on the premises of the building in which the apartment is located, interruptions in the supply of utilities (including electricity, water, heating), or noise from neighbouring properties. 

An additional fee of PLN 100.00 will be charged for each unjustified call-out of staff. 

In the event of unforeseeable circumstances whose effects cannot be immediately eliminated by customary means, Comfort Apartments reserves the right to offer the Guest a replacement property similar to the one originally booked. Comfort Apartments has the right to withdraw from the Agreement in the event of force majeure. This also applies to cases in which the personal safety of the Client or their property cannot, for reasons beyond Comfort Apartments' control, be guaranteed. Amounts paid by the client are subject to immediate refund, less amounts due for services already provided. 

A cleaning fee is charged for each stay (depending on the size of the apartment) after the guests' departure, as well as a local (spa) tax of PLN 2.20 per person/night in Gdańsk and Gdynia, and PLN 4.60 per person/night in Sopot.

The law applicable to disputes between Comfort Apartments and the client is Polish law. Disputes will be settled by the court with jurisdiction over the registered office of Comfort Apartments.

§ 8
PRIVACY POLICY

Personal data is protected in accordance with the Act of 29 August 1997 "On the Protection of Personal Data" (Journal of Laws No. 133, item 883) in a manner that prevents third parties from accessing it. 

In connection with the procedure of registering and purchasing hotel services provided by Comfort Apartments, by filling in the forms on our website, you voluntarily provide information regarding your first name, surname, residential address, email address, telephone number and credit card number, and consent to its processing in accordance with the Act. We wish to assure you that personal data will be processed solely by the data controller for the purpose of providing services, surveying your satisfaction, and presenting new offers and promotions, and that it will not be made available, sold or leased to other entities. All collected personal data is stored and processed with appropriate security measures meeting the requirements of Polish law. We have introduced and apply appropriate procedures to safeguard and restrict access to and the use of your personal data by unauthorised persons. 

Guaranteeing the exercise of your rights under the Personal Data Protection Act, Comfort Apartments provides the right to inspect, correct and obtain information at any time regarding the processing of personal data, as well as to have it deleted from the database, through direct contact with booking@comfortapartments.eu.
