§1
GENERAL PROVISIONS

These RENTAL REGULATIONS set out the terms and conditions that govern the booking and rental process for the apartments offered by Comfort Apartments. Making a reservation means acceptance of the RENTAL REGULATIONS of Comfort Apartments. The contract for short-term accommodation services is made between the Guest and Comfort Apartments. The Guest must be a person of full age. The contract signed with Comfort Apartments covers only the rental of the apartment (excluding any board or travel costs). Comfort Apartments reserves the right to refuse to accept a booking.

§2
MAKING BOOKINGS AND PAYMENT FOR A RENTAL APARTMENT

Booking methods:

After you have made a booking, you will receive a “Preliminary Booking Confirmation” for the apartment of your choice at your e-mail address together with the full cost of your stay and the exact address of the apartment. (Please note that our apartments are located at different addresses in Gdańsk, Sopot and Gdynia).

When booking online or through the websites, you should provide your credit card number, its expiry date as well as the full name of the person making the booking. When booking by phone or e-mail, you will receive a notice with an account number to which you should pay the amount for the guaranteed booking. As soon as your credit card is charged or the amount is recorded in our account, your booking will change its status to “Guaranteed Booking” and you will receive a “Booking Confirmation” to your e-mail address. If your credit card is not charged or the funds have failed to reach our bank account within the required period, we will understand you have withdrawn from the contract and cancelled the initial booking. The offer and the prices quoted on www.comfortapartments.eu are for information purposes only and do not constitute a commercial offer within the meaning of Article 66(1) of the Polish Civil Code. The price must be confirmed by a Comfort Apartments employee by phone or when booking online.

All prices offered by Comfort Apartments include VAT at the currently applicable rate of 8%. The price of your stay includes bed linen, towels, wireless Internet, utility charges (water, gas, electricity, heating) and parking, if available. The price of your stay does not include the final cleaning of the apartment and the tourist tax.

The tourist tax in the amount of 4.30 PLN per person daily is charged in cash. Comfort Apartments may issue an invoice if requested.

The dates of stay may be rescheduled only with the approval of Comfort Apartments and should be notified by phone or email.

§3
CANCELLATION OF A BOOKING

Free cancellation of the reservation is possible 14 days before arrival.

In the case of cancellation or withdrawal from the reservation later than 14 days before arrival, the amount paid to the account or debited to the credit card will forfeit.

If the stay is shortened, the Guest is not entitled to reimbursement for unused days of accommodation.

§4
ARRIVAL AND ACCOMMODATION

The Guest should notify the staff of the time of arrival at least one day prior. If the guest is unable to arrive at the pre-arranged time, they should contact the Comfort Apartments staff immediately.

Guests can check into the apartments located in the centre of Gdańsk at the Comfort Apartments office during the following hours:

from 3:00 pm to 7:00 pm – free of charge;

from 7:00 am to 11:00 pm – PLN 100 (payment must be in cash)

after 11:00 pm – PLN 150 (payment must be in cash)

Keys to the apartments located in Sopot, Gdynia and other districts of Gdańsk can be collected at the apartment address. In order to collect the keys, the Guest should contact an employee of Comfort Apartments at least 1 hour prior to arrival (the contact person’s number is shown in the “Booking Confirmation”).

Check-in starts at 3:00 pm (if possible, keys may be collected earlier by prior arrangement with the person responsible for handing over the keys). Check-in after 7:00 pm requires prior confirmation from the Comfort Apartments office. Comfort Apartments reserves the right to refuse to check in guests after 7 pm. Comfort Apartments reserves the right to charge a refundable deposit of up to PLN 1000.00 up to 7 working days prior to check-in. The deposit is collected in the form of a credit card pre-authorisation. The deposit is intended to secure Comfort Apartments’ claims in the event of damage or breach of any terms and conditions. In the event of no objections on the part of Comfort Apartments, the deposit will be returned to the client up to 7 working days from the date of departure.

§5
CHECK OUT AND DEPARTURE

Guests should check out by 11:00 am at the latest. Please, arrange the time and details of check-out the day before your departure at the phone number provided in the welcome letter or on our website. The Guest should leave the property in an undamaged condition as delivered to the Guest at check-in. If damage has occurred, the Guest will be financially liable for any damage to person or property caused by them or third parties in connection with the booked stay.

Guests can check out between 8:00 am and 11:00 am. Leaving the apartment after 11:00 a.m. without prior arrangement with Comfort Apartments staff will be treated as an extension of your stay by another 24 hours and charged according to the applicable price list. An extension of your stay must be reported to Comfort Apartments staff at the latest by 3:00 pm on the day preceding the end of the booking period. Your stay will be extended if Comfort Apartments has free apartments available.

§6
OBLIGATION OF THE CLIENT

The Client should maintain the premises in a good condition, observe the principles of community life and use the apartment according to its exclusive purpose, i.e. a tourist or business trip. It is forbidden to organise parties, photo sessions, etc. in the apartment and consume excessive amounts of alcohol. The occupants should not make noise at night from 10:00 pm to 6:00 am. Due to the location of the apartment in a residential building, failure to observe this rule may result in immediate termination of the rental contract and calling the police in more difficult cases, and is punishable by a fine of up to PLN 500.00 under Article 51(1) of the Polish Code of Petty Offences. Please, be advised that both guests of the apartment and residents of the entire building are entitled to report any incidents directly to the apartment manager. The number of people staying in the apartment must not be higher than that stated in the booking confirmation. In the event of a breach of this rule, Comfort Apartments has the right to terminate the contract with immediate effect without any obligation to refund the amount due for the remaining period of booking.

The Guest should immediately report to the apartment caretaker of any missing furnishings or damage found or caused.

Smoking and candles are strictly prohibited both in the apartment and in the entire building. For breaking this rule, in particular for smoking inside the apartment, the Guest may be charged a fine of PLN 500.00

For the term of accommodation, the Guest will have access to an apartment with fully operational furnishings and equipment. Any damage or destruction which the Guest finds in the apartment should be reported immediately to a Comfort Apartments employee. Failure to do so may result in the Guest being charged with the repair costs.

The Guest will be held financially liable for damage, destruction or loss of the apartment’s furnishings, equipment and technical devices caused by the Guest or their visitors. In the event of any damage, the Guest should notify the apartment manager immediately upon discovery.

Neither the apartment owner nor the manager may be held liable for any loss or damage of: money, documents or other items important or valuable to you. Please, lock the entrance door at all times, whether you are inside the apartment or away and close the windows before leaving the premises. Please, take special care of the apartment keys. If they are lost, the Guest will be charged an additional fee of up to PLN 500.00. The Guest may not give the keys to third parties, and any third parties staying in the apartment should leave by 10 pm at the latest.

Should the apartment manager be notified by other guests or residents of the building of a gross breach of any of these rules, the Guest should be aware that the rental contract may be terminated immediately with no right of refund for the unused days of the stay.

§7
OTHER INFORMATION

Comfort Apartments will not accept responsibility for any inconvenience caused during your stay due to construction or finishing works that may be carried out on the building in which the apartment is located, interruptions in the supply of utilities (e.g. electricity, water, central heating) or noise from neighbouring properties.

An additional fee of PLN 100.00 will be charged for each unjustified service call.

In the event of unforeseeable circumstances, the effects of which cannot be immediately eliminated by customary means, Comfort Apartments reserves the right to offer the Guest a substitute facility similar to the facility originally booked. In the event of force majeure events, Comfort Apartments has the right to withdraw from the contract. This also applies if the personal safety of the Client or their property, for reasons beyond the control of Comfort Apartments, cannot be guaranteed. Amounts paid by the Client are then immediately refundable, subject to deductions of amounts due for services already provided.

For each stay we charge a cleaning fee (whose amount depends on the size of the apartment) as well as a tourist tax at a daily rate of PLN 2.20 per person in Gdańsk and Gdynia and at a daily rate of PLN 4.60 per person in Sopot.

The law applicable to disputes between Comfort Apartments and the client is Polish law. Disputes will be settled by the court having jurisdiction over the headquarters of Comfort Apartments.

§8
PRIVACY POLICY

Personal data are protected under the Polish Personal Data Processing Act of 29 August 1997 (Journal of Laws No. 133, item 883) in such a way that they cannot be accessed by third parties.

In connection with the registration procedure and the purchase of hotel services provided by Comfort Apartments, by filling in the forms on our website, you voluntarily provide information concerning your name, surname, home address, e-mail address, phone number, credit card number and you consent to their processing in accordance with the Act. We would like to assure you that your personal data will only be processed by the data controller for the purpose of providing services, measuring your satisfaction, presenting new offers and promotions and that they will not be disclosed, sold or leased to other parties. All collected personal data are stored and processed with appropriate security measures that meet the requirements of Polish law. We have put in place and apply appropriate procedures to secure and limit access and the possibility of unauthorised use of your personal data.

In order to safeguard the exercise of your rights under the Polish Personal Data Protection Act, Comfort Apartments allows you to inspect, correct, and obtain information at any time regarding the processing of your personal data, as well as to have it removed from the database by directly contacting us at booking@comfortapartments.eu.
