GENERAL PROVISIONS
These RULES determine the terms of lease according to which it is possible to reserve individually and to lease apartments included in the offer of Comfort Apartments. Making a reservation is tantamount to the acceptance of the provisions of the RULES of lease of Comfort Apartments’ apartments. The agreement for the provision of short-term accommodation services between the Guest and Comfort Apartments. The Guest must be an adult person. Each agreement concluded with Comfort Apartments encompasses only the lease of the apartment (without food and travel). Comfort Apartments stipulates the right to refuse the acceptance of the reservation.
§2
RESERVATION AND PAYMENT FOR APARTMENT LEAS
Methods of reservation:
Upon completion of the reservation process, a Preliminary Confirmation of Reservation of the apartment selected by you along with the cost of the entire stay and the detailed address of the apartment will be sent to your e-mail address. (Please note that our apartments are located at various addresses in Sopot, Gdynia and Gdańsk).
If the reservation is carried out online or via reservation portals, you are obliged to state your credit card number as well as its validity date and the full name of the person making the reservation.
If the reservation is carried out by phone or by e-mail, you will receive information with the account number to which an amount should be paid in respect of the guaranteed reservation.
After your credit card is debited or the paid amount is credited to the account, the status of the reservation changes to Guaranteed Reservation; as a result of this, a Confirmation of Reservation will be sent to your e-mail address.
The lack of possibility of debiting the credit card or the lack of payment to the bank account in respect of the reservation at the designated time means withdrawal from the agreement or the automatic cancellation of the initial reservation.
The offer and prices stated on www.comfortapartments.eu are provided for your information only and should not be regarded as a commercial offer within the meaning of Art. 66 par. 1 of the Civil Code. The price must be confirmed by an employee of Comfort Apartments by phone or during the online reservation.
All prices offered by Comfort Apartments contain the currently applicable amount of VAT (8%).
The price of stay includes: bed linen, towels, wireless Internet, utility charges (water, gas, electricity, heating).
The price of stay does not include parking, the fee for the final cleaning of the apartment and the climate fee.
The climate fee of 4.30 PLN per person per day is collected in cash.
At the Guest’s request, Comfort Apartments may issue an invoice.
The time of the reservation may be changed only with the consent of Comfort Apartments and must be reported by phone or by e-mail.
§3
CANCELLATION OF RESERVATION
The free cancellation of the reservation is possible 14 days before arrival.
In the case of cancellation or withdrawal from the reservation later than 14 days before arrival, the amount paid to the account or debited to the credit card will forfeit.
If the stay is shortened, the Guest is not entitled to reimbursement for unused days of accommodation.

ARRIVAL AND ACCOMMODATION
The Guest is obliged to notify the personnel about the planned time of acceptance of the apartment not later than one day before arrival. If it becomes impossible for the Guest to arrive at the previously agreed time, the Guest will contact the personnel of Comfort Apartments immediately.
Accommodation takes place during the following hours:
The hotel day begins at 3:00 p.m. (if this is possible, keys may be collected earlier upon prior arrangement with the person responsible for the handover of keys).
Comfort Apartments stipulates the right to collect a refundable security deposit of 500 PLN. The security deposit may be collected in cash or secured with credit card data. The purpose of the security deposit is to secure claims of Comfort Apartments in the case of potential damages or violation of individual points of the Rules. If no objections are made by Comfort Apartments, the security deposit is returned to the customer in full on the day of departure.
§5
CHECKING OUT AND DEPARTURE
The hotel day ends at 11:00 a.m. We request you to arrange the checkout time one day before departure at the phone number stated in the welcome letter or on our website. The keeper of the apartment will arrive to you, return the security deposit and collect the keys to the apartment. The Guest will leave the premises in a condition not worse than at the time of their acceptance. If damages have occurred, the Guest will bear financial responsibility for all personal injuries or material damages arising through his fault or through the fault of third parties in connection with the reserved stay.
The check-out time is from 8:00 a.m. till 11:00 a.m. The Guest’s departure from the apartment after 11:00 a.m. without prior arrangement with the personnel of Comfort Apartment will be treated as a prolongation of the stay by another hotel day and calculated as per the valid price-list. The prolongation of the stay must be notified to the personnel of Comfort Apartments not later than by 3:00 p.m. on the day preceding the expiry of the time covered by the reservation. The prolongation of the stay will take place if Comfort Apartments has free apartments at its disposal.
§6
CUSTOMER’S OBLIGATIONS
The Customer is obliged to keep the premises in proper condition, comply with the rules of good neighbourhood, use the apartment in accordance with its intended function only for the purpose of a recreation & tourist stay or a business trip. Organising parties, photo sessions etc. or the consumption of alcohol in excessive quantities in the apartment is prohibited. The curfew in the apartment lasts from 10:00 p.m. till 6:00 a.m. As the apartment is situated in a residential building, failure to comply with this point may result in the immediate termination of the lease agreement and, in more difficult cases, calling the police and is subject to a fine in the amount not exceeding 500 PLN according to Art. 51 par. 1 of the Code of Offences. We inform you that both Guests of the apartment and inhabitants of the entire building are authorised to report all incidents directly to the Administrator of the apartment.
The number of persons staying in the apartment may not be bigger than the number declared in the confirmation of reservation. In the case of violation of this point, Comfort Apartments is entitled to terminate the Agreement with immediate effect without having to reimburse the amount due in respect of the remaining period of reservation.
The Guest is obliged to report immediately any missing parts of the apartment equipment and damages found or done in the apartment to the keeper of the apartment.
Smoking and burning candles is absolutely prohibited in the apartment and in the entire house. The Guest may be charged with a financial penalty in the amount of 500 PLN for breaking this prohibition, particularly for smoking in the apartment.
During accommodation, the Guest receives the apartment along with fully operational equipment at his disposal. The Guest is obliged to notify any damages or destructions found in the apartment immediately to an employee of Comfort Apartments. Failure to make such notification may mean that the Guest will be charged with costs of the repair.
The guest of the apartment bears full financial responsibility for all kinds of damages, destructions or missing parts of equipment and technical devices of the apartment arising through his fault or through the fault of visitors. In the case of occurrence of any damages, the Guest should notify the administrator of the apartment immediately after their ascertainment.
The owner and the administrator of the apartment are not responsible for any loss or damage of money, documents or any other items that are important or costly for you. We request you to lock the entrance door in each case, both during your stay in the apartment and during your absence, and to close the windows before leaving the apartment. We request you to be particularly careful not to lose keys to the apartment. In the case of their loss, the Guest will have to pay 500 PLN. The Guest of the apartment may not hand it over to any third parties, and third parties staying in the apartment are obliged to leave it by 10:00 p.m.
If the administrator of the apartment is notified by other guests or inhabitants of the building about the gross violation of any of the points of these Rules, the Guest should realise that the lease agreement may be terminated with immediate effect with full payment for the unused days of stay.
§7
ADDITIONAL INFORMATION
Comfort Apartments will not be responsible for any inconveniences arising during the Guest’s stay in connection with building and finishing works that may be performed on the premises where the apartment is situated, interruptions in the supply of utilities (e.g., electricity, water, central heating), noise from adjacent real properties.
For each case of calling the staff without a justified reason, an additional fee of 100 PLN shall be imposed.
In the case of occurrence of unforeseeable circumstances whose consequences cannot be immediately liquidated by ordinary means, Comfort Apartments reserves the right to propose a replacement facility similar to the originally reserved facility to the Guest. Comfort Apartments is entitled to withdraw from the Agreement in the case of force majeure events. This also applies to cases in which the personal safety of the Customer or its property cannot be guaranteed for reasons beyond the control of Comfort Apartments. Any amounts paid by the customer are immediately reimbursable, with deduction of amounts due for already rendered services.

The relevant law for disputes between Comfort Apartments and the customer is the Polish law. Disputes will be settled by a court having jurisdiction over the registered office of Comfort Apartments. The price of each stay will be increased by a fee for cleaning the apartment (depending on the size of the apartment) after guests’ departure and a climate fee (resort fee) of 2.20 PLN per person/day in Gdańsk and Gdynia and of 4.30 PLN per person/day in Sopot.

PRIVACY POLICY
Personal data are protected pursuant to the Personal Data Protection Act of 29 August 1997 (Journal of Laws No. 133 item 883) in a manner preventing third parties from accessing them.
In connection with the procedure for registration and purchase of hotel services provided by Comfort Apartments, by filling in the forms available on our website, you voluntarily make available the information concerning your full name, address of residence, e-mail address, phone number, credit card number and you agree to their processing pursuant to the Act. We want to assure you that personal data will be processed only by the data administrator for the purpose of providing services, analysing your satisfaction and presenting new offers and promotions and that they will not be made available, sold or leased to other entities. Any collected personal data are stored and processed with the use of relevant safety measures meeting the requirements of Polish law. We have introduced and use relevant procedures securing and restricting access to your personal data and the possibility of their use by unauthorised persons.
Guaranteeing the exercise of your rights resulting from the Personal Data Protection Act, Comfort Apartments gives you the right to access, correct and obtain at any time information concerning the processing of personal data, and to delete them from the database by contacting directly h.nowak@comfortapartments.eu.
